Most attorneys are aware of the complex social histories that many of their clients share, but many don't know how to effectively present those details, experiences, and traumas with persuasiveness or cohesiveness. That’s where our team comes in.
We complete a thorough investigation into each client's background by collecting and summarizing records, and interview them and their families, coordinating with other experts when necessary. We incorporate important themes, theories and research from the fields of social work, psychology, criminal justice, and sociology into written reports and presentations.
Ultimately, our team helps demonstrate a client's humanity so prosecutors and judges can better understand why an offense occurred and what sentence or outcome is appropriate.
What is mitigation?
In 2003, the American Bar Association (ABA) published its Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases, which established practice standards to ensure high quality representation for those individuals who were facing the death penalty. Today, mitigation specialists continue to work in capital cases around the country, but they are also commonly hired to work in felony cases at the state and federal level. The increased use of mitigation specialists has occurred because of positive developments in the law, including changes in the way that federal sentences are determined, and U.S. Supreme Court cases which acknowledge the importance of considering an individual’s life, background, and rehabilitative potential prior to sentencing someone to an extended term of years or life in prison. Ultimately, a mitigation specialist will become a member of the defense team and help demonstrate a client's humanity so that prosecutors, judges, or juries can better understand why an offense occurred, how life experiences shaped a person’s identity and functioning, and why a sentence or outcome may or may not be appropriate.
At SSMS, we believe that every client deserves the chance to have his or her story told to the person who will be deciding the outcome of their case, whether it is a prosecutor, judge, or the jury. Upon retention, we will conduct a thorough investigation into each client's background by interviewing the client, family members, and collateral contacts; reviewing records; finding and coordinating with other experts if it is necessary; and incorporating important themes, theories, and research from the fields of social work, psychology, criminal justice, and sociology into written reports and presentations. We understand that every person is unique, and our ability to assist meaningfully in the presentation of mitigating evidence is aided by our separate clinical journeys as a licensed clinical social worker and licensed clinical professional counselor. We work on behalf of every client with dedication, passion, and care. We work with every attorney aiming to achieve the best results possible while also being guided by our high ethics, standards, and knowledge about various practices in the field.

Mitigation specialists are obtained and used in capital cases, or those cases in which the death penalty will potentially be sought if the client is found guilty after trial. This work requires the application of the highest standards and practices, and typically involves many months of investigation as well as involvement of various experts in the fields of neurology, psychology, education, and elsewhere. In this kind of case, we work to produce various summaries and chronologies so that all mitigating factors in a defendant's background can be explored and investigated. Work can occur at the pre-certification stage or at the sentencing phase, when success would mean a life sentence without the possibility of parole rather than death.

Mitigation specialists are hired to work for juvenile justice involved clients, most often when the client is facing discretionary transfer to adult court or otherwise looking at adult-like treatment. This work requires the identification of factors which may have contributed to a minor’s involvement in the criminal justice system. It will include exploring issues such as trauma, mental health struggles, family dynamics, and societal influences, among other things. By understanding these underlying factors, a more holistic and individualized approach to addressing the needs of the juvenile offender becomes more apparent, and one of the mitigation specialist’s goals is to promote rehabilitation and identify the support and resources a client needs to move forward positively.

Mitigation specialists are hired to work in post-conviction cases to ensure that the defendant receives a fair and just outcome in their post-conviction proceedings. This work involves gathering and presenting evidence which can potentially overturn their prior conviction or allow them to receive a resentencing. It involves interviews of the client, family members, friends, and other individuals who can provide insight into the defendant's background and mental health history, as well as review of past submissions to see what documentation or records were not sought or used in prior proceedings.

Mitigation specialists are frequently hired to work with clients charged in serious felony criminal cases at the pre-trial stage. This work involves gathering and presenting evidence to the prosecution with a goal of lessening the severity of the charges or the sentencing outcome for the defendant. Work involves interviews with the client and their family, obtaining medical and mental health records, collecting character references, and talking to others with knowledge of the client. The goal of mitigation work would be to humanize the client, provide context for their actions, and highlight any mitigating factors which may have contributed to the alleged criminal behavior. By presenting information early in the case, defense attorneys can potentially negotiate a more favorable plea deal or sentencing outcome for their client. In some jurisdictions, mitigation specialists are also used to present information to judges who will hear information presented during legal conferences with the attorneys.

Mitigation specialists are often hired to assist in cases at the sentencing phase, post-trial or post-plea. Work can occur at the state or federal level, and the goal either way would be to ultimately reduce the severity of the sentence imposed by highlighting mitigating factors which might otherwise not be learned or considered. Work would include interviewing the client, family members, and collateral contacts, but it also a review of records to better understand a client’s prior experience with mental illness, substance use, educational issues, or adverse childhood experiences. A mitigation specialist should not be retained right before the sentencing hearing date as a thorough mitigation investigation cannot be conducted in a short time frame.

Helen Kim Skinner is the founder of Strategic Sentencing Mitigation Services, formerly known as HKS Mitigation Services. She is a mitigation specialist who is also licensed as an attorney in the State of Illinois and licensed as a Clinical Social Worker (LCSW) in the State of Illinois. She serves as an adjunct faculty member in the Child and Family Law Programs in the Graduate Legal Studies department at Loyola University Chicago School of Law, and she works as an independent contractor with the Federal Defender Program in Chicago, supervising graduate social work students. She previously worked as a staff attorney at the Federal Defender Program, where she created the social work internship program and assisted in the formation of the James B. Moran Second Chance Program, a federal reentry court in the Northern District of Illinois. Prior to becoming a private mitigation specialist, she was a staff attorney at the Federal Defender Program, an Assistant Public Defender for the Cook County Public Defender’s Office, and an adjunct professor at Loyola School of Social Work and DePaul College of Law.

Tatiana Duchak

Tatiana Duchak is an Associate Mitigation Specialist at Strategic Sentencing Mitigation Services. She is licensed as an attorney in the State of Illinois and licensed as a Clinical Professional Counselor (LCPC) in the State of Illinois. She serves as an adjunct instructor at North Park University, where she teaches undergraduate psychology courses. She also supervises graduate student counseling interns. Before entering the legal field, she spent over a decade working in forensic mental health, including roles in state psychiatric hospitals, jails, prisons, domestic violence crisis response, and child welfare where she developed deep knowledge and understanding in the treatment of trauma.

Additional team members
Other SSMS team members will include individuals who specialize in requesting records from various institutions and digesting those records, as needed, for ease of use by the defense team. We also contract with individuals who are trained to be mitigation assistants. These individuals may conduct research, collect character references, or interview individuals with whom the client has had personal, recreational, or professional relationships.
